By accessing or using the One-Up Travel platform ("Service"), including our website at one-up.cloud and any associated applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

One-Up Travel is operated by One-Up Travel Pty Ltd ("we", "us", "our"), a company registered in Australia.

2. Eligibility & Accounts

You must be at least 18 years old to use this Service. By creating an account, you represent that you are of legal age and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.

3. AI-Powered Services

Our platform uses artificial intelligence ("Lisa") to provide travel recommendations, itinerary planning, and related services. While we strive for accuracy, AI-generated content is provided on an "as-is" basis. You acknowledge that:

  • AI recommendations are suggestions only and should not be treated as professional travel advice
  • Prices, availability, and details shown are estimates and may differ from actual offerings at the time of booking
  • You are responsible for independently verifying all travel information, including visa requirements, health advisories, and safety conditions
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated content

4. Third-Party Services & Bookings

One-Up Travel integrates with third-party providers including but not limited to airlines, hotels, tour operators, and booking platforms. When you make a booking through our platform:

  • Your contract is directly with the third-party provider, not with One-Up Travel
  • Third-party terms and conditions, cancellation policies, and pricing apply
  • We act as an intermediary and are not liable for the quality, safety, or delivery of third-party services
  • Disputes regarding bookings should be directed to the relevant provider

We may earn affiliate commissions from bookings made through our platform. This does not affect the price you pay.

5. Payments & Pricing

All prices displayed on the platform are in Australian Dollars (AUD) unless otherwise stated. Currency conversions are provided for convenience only and may not reflect real-time exchange rates.

We reserve the right to change our pricing structure, introduce paid features, or modify free tier offerings at any time with reasonable notice to existing users.

6. Intellectual Property

All content on the One-Up Travel platform, including but not limited to text, graphics, logos, icons, software, and the overall design, is owned by or licensed to One-Up Travel and is protected by Australian and international intellectual property laws.

Photos and reviews displayed from third-party sources (such as Google Places) are the property of their respective owners and are displayed under licence or fair use provisions.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or extract the source code of our software
  • Scrape, crawl, or use automated tools to access the Service without our consent
  • Interfere with or disrupt the Service or its servers
  • Impersonate any person or entity, or misrepresent your affiliation
  • Upload malicious code, viruses, or harmful content
  • Use the AI features to generate harmful, misleading, or illegal content

8. Limitation of Liability

To the maximum extent permitted by Australian law, One-Up Travel and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Our total liability to you for any claims arising from the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded under Australian Consumer Law.

9. Termination

We may suspend or terminate your account at our discretion if you breach these Terms. You may delete your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and governing law survive termination.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

  • Comply with legal obligations

We will not sell your personal information to third parties. We will not use your information for purposes unrelated to our Service without your consent.

4. How We Share Your Information

  • Third-party booking providers — when you make a booking, we share necessary details with the relevant airline, hotel, or tour operator
  • Service providers — companies that help us operate the platform (hosting, analytics, email delivery), bound by confidentiality agreements
  • AI service providers — to process your conversations with Lisa (anonymised where possible)
  • Legal authorities — when required by law, regulation, or legal process

We do not share your personal information with advertisers or data brokers.

Your data may be processed in countries outside Australia, including the United States, where our cloud service providers operate. We ensure appropriate safeguards are in place, including data processing agreements and compliance with applicable privacy frameworks.

  • Secure authentication through Firebase Authentication
